Each and every client is treated with respect. Universal Recruiting strives to provide the best quality of advice, service and expertise.

When making use of our services, you agree to our Terms of Service. If these terms are unacceptable to anyone for any reason, they may not use our services.

Terms of service regarding the Universal Recruiting website

1. Your use of the website:

Universal Recruiting grants you a revocable, limited and non-exclusive right to access and interact with the Universal Recruiting website. You may not engage in any activity which can cause harm or make changes to the website, software, servers or data, including the following:

a. Other than page caching done by your browser, you may not modify, disassemble, reproduce, reverse engineer, create derivative works of, scrape or copy anything on the website without written authorization. You may not reproduce, translate, publish, distribute, or benefit in any way from the website, its content or the systems in place to enable and maintain it.

b. You may not gain – or execute any attempt to gain – unauthorized access to our website, software or infrastructure, or use data mining tools, automated software, hacks, exploits or modifications, or any use other similar tools to extract data or exploit or harm our systems.

c. You may not frame, or apply any framing techniques to any part of the Universal Recruiting website for any reason, including images, text, page layout, or forms, for any reason whatsoever.

d. You may not use any of the website’s meta tags or any other hidden text or code which uses Universal Recruiting’s name, trademarks, corporate logo or any proprietary information.

e. You may create a hyperlink to any page the Universal Recruiting website, provided that the link/s in question does not portray Universal Recruiting or any of its services offered in a false, misleading or offensive way. You may not link to Universal Recruiting if your website is of poor quality, or connected to the adult industry in any way.

f. You may not hotlink to any image on the Universal Recruiting website.

All of the content, graphics, data, forms and documents on the Universal recruiting website remains the intellectual property of Universal Recruiting. You may not use any of our proprietary information without express written consent.

2. Lawful purposes

2.1. You hereby agree and undertake to not use the Universal Recruiting website in any illegal, unethical or harmful way. You may not, in any way or by any means, do any of the following:

a. Monitor, intercept, modify or prevent delivery of any communication intended for someone other than yourself.

b. Use any software or bot, including but not limited to, viruses, trojans, worms or any other code, executable or not, to delete, damage, distort or disassemble any part/all of Universal Recruiting’s website, services or communications.

c. Send out any unsolicited email to Universal recruiting or any of its clients, or send out any emails charading as Universal Recruiting or one of its employees.

d. Engage in any illegal, threatening, abusive or any other offensive or objectionable communications with Universal Recruiting, its staff or any of its clients regarding said clients’ dealings with Universal Recruiting.

2.2. You hereby declare that any funds used to pay for any service from Universal Recruiting has been obtained lawfully, and that you will not use the Universal Recruiting website and/or its services as a monetary transfer system or money laundering.

3. Indemnification

3.1. Universal Recruiting reserves the right to, at its sole discretion, alter, expand, reduce or discontinue, and add or remove any content, service and/or feature on the website, or make changes to its pricing, at any given time without prior notice.

3.2. You agree and acknowledge that Universal Recruiting is under no obligation to provide access to you or any additional party/parties, to any previous version/s of the website or part thereof, features or modified/discontinued services.


Terms of service regarding recruitment (for employers):

References to singular also include the plural, except in cases where context implies otherwise.

Any headings displayed are merely for ease of reading, and do not affect the interpretation of the subsequent content.

1. The Agreement:

1.1. The client/employer is deemed to have entered into an agreement with Universal Recruiting upon any introduction (of the applicant/candidate to the client/employer), any engagement with a candidate/employment, or if any information regarding the candidate is passed to a third party after an introduction.

1.2. Unless agreed to in writing by the CEO of Universal Recruiting, these terms amount to the agreement between the parties. The terms of this agreement supersede any terms or conditions forwarded by the client.

1.3. Any alteration of the agreement will be null and void unless such alteration is agreed to by both the client and Universal Recruiting, set out in writing, and a copy stating the effective start date is provided to the Client.

2. Fees and Notifications

2.1. The client undertakes to:

2.1.1. Notify Universal Recruiting immediately in the event of any offer of an engagement made to the candidate.

2.1.2. Notify Universal Recruiting immediately should the candidate/applicant accept the offer of engagement, and provide details of any agreement reached with the candidate/applicant.

2.1.3. To settle any invoice/fees within 14 days of the date of the invoice.

2.2. Aside from the circumstances stated in 2.2.1 below, Universal Recruiting’s fee to the client is only incurred once the candidate/applicant’s engagement commences, at which time Universal Recruiting will submit an invoice to the client for its fee.

2.2.1. If any offer of engagement is made to the candidate, and the client chooses to withdraw the offer for any reason, the client will remain liable for a minimum of 50% of the agreed fee.

2.3. Universal Recruiting reserves the right to demand interest on any invoice that remain unpaid for more than 30 calendar days after the due date until such time it is paid in full.

3. Refunds

3.1. If the engagement/employment terminates within 12 weeks from commencement, the client is entitled to a partial refund provided that:

3.1.1. The invoice for Universal Recruiting’s fee was settled within 14 days of its date of issue, and the client notified Universal Recruiting of the termination within 7 days.

3.2. Refund rates, calculated according to the working week from commencement of engagement/employment during which the candidate/employee leaves:

1 2 weeks – 90%
3 4 weeks – 80%
5 6 weeks – 60%
7 8 weeks – 40%
9 10 weeks – 20%
11 12 weeks – 10%

3.2.1. In the event of the engagement/employment being terminated during or after the 13th week of commencement, there will be no refund payable to the client.

3.3. If the engagement is terminated, but the client and the candidate should re-engage within a period of 180 days, the full fee will be payable to Universal Recruiting.

4. Introductions

4.1. The client agrees to the confidentiality of candidates’ information. Any disclosure of any candidate information by the client to a third party, within a 12-month period after introduction of the candidate to the client, which results in an engagement with said third party, will leave the client liable to pay Universal Recruiting’s fee without being entitled to any refund if said engagement should terminate prematurely.

4.2. If any introduction of the candidate to the client results in an engagement/employment within a period of 12 months from said introduction, whether directly or indirectly, the client will be liable to pay Universal Recruiting’s fee.

4.3. In the event that engagement/employment takes place after introduction but without the involvement of Universal Recruiting, and the actual remuneration is not known to Universal Recruiting, the fee will be calculated based off either (a) the minimum rate for the specific position as set out by the client, or (b) according to the remuneration generally offered for similar positions in the job market.

5. Suitability and references

5.1. Universal Recruiting will endeavour to ascertain the suitability of any candidate/applicant – which is introduced to the client – by obtaining confirmation of the following:

a. The candidate’s identity.

b. The candidate’s qualifications, including job-specific training as required by the client.

c. The candidate’s work experience, including job-specific experience as required by the client.

c. That the candidate possesses all the accreditation and/or certifications required by law or professional bodies.

d. That the candidate is in fact willing to accept the engagement offered by the client.

5.2. When proposing a candidate to the client, Universal Recruiting will provide confirmation of all the items in 5.1 within three business days of the proposition (Saturdays, Sundays and public holidays excluded), unless the candidate is already working in a similar position in Canada, and the information has already been supplied to their current employer.

5.3. Universal Recruiting undertakes to take any and all reasonable steps to ensure that both the candidate and the client are informed about any legal or professional (body) requirements which will enable the candidate/applicant to engage in the position offered by the client.

5.4. Universal Recruiting undertakes to take all reasonable steps to ensure that neither the client nor the candidate will be negatively affected by the candidate working in the position offered by the client.

5.5. Notwithstanding the stipulations in 5.1, 5.2, 5.3 and 5.4, the client will examine the candidate’s suitability and references as provided by the candidate or Universal Recruiting before engaging with/employing the candidate.

It is the client’s responsibility to ensure that all professional and legal requirements are met before engaging the candidate.

5.6. In order to enable Universal Recruiting to fulfill its obligations as set out in 5.1, 5.2, 5.3 and 5.4, the client will provide Universal Recruiting with complete details regarding the position offered by the client, including – but not limited to – the following:

a. The type of work the candidate will be required to do.

b. The working conditions that come with the position.

c. Working hours, including expected overtime hours.

d. Experience required, including job-specific experience.

e. Qualifications required, including job-specific qualification and training.

f. Any certifications and accreditation as required by law or professional body.

g. Any potential risks to the candidate’s health and/or safety, including mental health.

h. Any steps the client has implemented to manage or eliminate said risks.

i. Minimum rate of remuneration, remuneration intervals, benefits and expenses.

j. The required length of notice the client requires in the event of the candidate wishing to terminate their employment with the client.

6. Liability

Universal Recruiting will not be liable – under any and all circumstances – for any losses, expenses, damages, costs incurred or delays, whether these be direct, indirect or consequential, which the client may suffer – whether arising from or connected with in any way – due to Universal Recruiting seeking a suitable candidate/applicant for the client, introducing a candidate to the client, engagement of the candidate by the client, or from Universal Recruiting failing to introduce any suitable candidate.


Terms of service regarding immigration (for applicants/candidates):

1. Paid services

1.1. You hereby acknowledge that any fee or payment made to Universal Recruiting will be in return for services rendered, including processing and handling/storage of personal data, as well as the (immigrant) settlement fee of $15,000 (CAD).

1.2. Universal Recruiting reserves the right to, it its sole discretion, modify, discontinue or limit access to any part/s of its website. Any and all of the terms of service will apply to any paid service unless explicitly stated otherwise.

1.3. The website user may use the Universal Recruiting website’s forms to ascertain their eligibility for immigration, and/or to submit immigration data, subject to the payment of fees as indicated.

1.4. Fees for all services relating to immigration and/or finding jobs for applicants are payable in advance.

2. Transactions and fraud

2.1. If any problem regarding payment arises, including a refund request, the user agrees to first contact Universal Recruiting to arrange settlement, and not directly cancel the (card) transaction via their bank. In the even that any user unilaterally initiates a charge-back, Universal Recruiting reserves the right to dispute the claim.

2.2. Universal Recruiting reserves its right to perform background checks, credit checks, verification of qualifications and credentials, as well as work experience of any candidate, whether in its own capacity or by making use of a third party service provider to do so.

2.3. Universal Recruiting makes use of third party electronic payment processors to accept payments on its website for services to be rendered, but reserves the right to accept direct payments/bank wire payments at is sole discretion.

2.4. If Universal Recruiting suspects, at is sole discretion, any fraudulent payments, the use of a stolen credit card/s, fraudulent charge-backs or any other fraudulent activity, we reserve the right to not only discontinue any services, but also to cancel or block any refund. Any fraudulent activity will also be reported to the appropriate authorities.

3. No guarantee of visa acceptance

3.1. The user understands that visa programs are implemented by Canadian authorities which act within their own set of laws, policies and regulations. As such, Universal Recruiting cannot guarantee the granting of any visa application.

The Canadian government reserves its right to, at any given time, modify or discontinue ony of its visa programs, and/or modify the eligibility requirements for any given visa program.

3.2. Universal Recruiting has no authority or influence, nor is in any way involved in the issuing of visas or immigration processes. Universal does provide information relating to the status of any give application, and will endeavour to inform potentially unsuccessful applicants of the probabilities of success or failure before they apply for a visa.

3.3. Universal Recruiting will inform, to the best of its abilities, users/applicants about eligibility requirements for the different Canadian visa types. It is the responsibility of the user/applicant to review such requirements, and ascertain whether they qualify according to the guidelines.

Universal Recruiting will endeavour to provide factually accurate assistance if the user/applicant request clarity on any given requirement.

3.4. Universal Recruiting will not, and is not authorized or licensed to provide any advice, consultation or representation regarding any legal questions or situations, not does it claim to be able to.

3.5. Authorized representatives:

a. The user/applicant both acknowledges and agree that Universal Recruiting may, at its sole discretion, grant limited access (to its website, servers and data) to third party service suppliers in order to execute its operations, including but not limited to licensed visa- and immigration consultants, lawyers and website administration/development consultants.

b. Such access does not automatically establish a consultant-client relationship, or an attorney-client relationship between the user/applicant and the appointed/authorized service provider.

c. The user/applicant acknowledges and agrees to allowing access to their information by any service providers as stated in (a) in order to facilitate processing of information and visa/immigration applications.

d. A preliminary (immigration) assessment does not constitute advice on immigration or obtaining a visa, and does not guarantee that any visa/immigration application will be successful.

4. Fees and refund policy

4.1. Any fees paid to Universal Recruiting will be applied towards time and fees paid in order to provide the services paid for by the user/applicant/candidate.

In the event of payment made via card or Stripe/Paypal, the applicant will be charged immediately, even if it is not possible to commence processing of the application or documentation right away.

By making Use of Universal Recruiting’s services, the user/applicant/candidate agrees to the stipulation of the refund policy stated below:

4.2. Universal Recruitment does not guarantee any specific outcome, and as such no user/applicant is deemed eligible for a refund if said outcome is not reached/achieved. While Universal Recruiting will always endeavour to ensure a positive outcome, there are parts of the process that are beyond our control. We collect a fee for our time, effort and expertise, regardless of the outcome.

4.3. In the event that a refund is indeed given, both the decision to refund and the amount paid shall be at the sole discretion of Universal Recruiting.

4.4. Regardless of the stipulation in (4.3.), the user/applicant will be deemed ineligible for a refund in the event of any of – but not limited to – the following:

a. Breach of terms of service, or suspicion of breach of terms of service due to an attempt/s to hinder the operations of Universal Recruiting,

b. Causing problems and/or legal liabilities,

c. Engaging in in fraud or any other illegal activities, or

d. Infringing on intellectual property rights.

e. Filing of an application that is impossible to process due to circumstances beyond the control of Universal Recruiting, including – but not limited to – acts of nature, war, technological problems or limitations, legislative or policy/procedural changes, or changes to the requirements of any visa program applied for.

4.5. A user/applicant may submit a refund request in writing via email or contact form. Universal Recruiting’s management will consider said refund request, and endeavor to determine the outcome within 5 working days.

In some cases, however, more time may be required, depending on the nature/details of the user/applicant’s request.

If the filing/application process has already commenced, even if it is/was on hold due to insufficient information, the user/applicant will not be eligible for a refund.

4.6. In the event that Universal Recruiting does approve a refund, deduction will be made for any money, time and effort already spent on the case.

4.7. Refunds will only be made using the exact same method used to make the original payment to Universal Recruiting.

Confidential information

5.1. Aside from the information required by payment systems and online forms, Universal Recruiting may request any additional information it deems necessary to ensure the best probability of success for the user/applicant’s visa/immigration application.

5.2. When sharing any information with Universal Recruiting, personal or otherwise, such information will be deemed non-confidential. By sending it to Universal Recruiting, the user/applican grants Universal Recruiting an unrestricted license to use, copy, alter or create derivative works, and distribute and/or display the information contained – regardless of whether or not it contains concepts or ideas, technical information or techniques, for any purpose it seems fit.

6. Communications

Upon submission of your information, the user/applicant hereby explicitly consent to receive communications via any means of communication relating to services, promotional content and advertisements from Universal Recruiting, whether or not it is on behalf of a third party, as well as service-related communications from any third party service provider appointed by Universal Recruiting to assist with its operations.

The user/applicant my opt out from promotional material and advertisements by contacting Universal Recruiting support, but cannot opt out of communications relating to the services provided by Universal Recruiting.

7. Security

Universal Recruiting endeavours to maintain security measures in line with industry standards and standard procedures for all services and its website in order to safeguard confidential information against unauthorized use.

When making payments on the website, all information is encrypted using SSL (Secure Socket Layer) software.

Despite all of Universal Recruiting’s efforts at providing effective security, it is impossible to guarantee absolute security, and it is not possible to guarantee that unauthorized persons/hackers won’t be able to breach our systems and access the data of users/applicants.

If any user/applicant finds this risk to be unacceptable, they are advised to not make use of Universal Recruiting’s services.

8. Immigration laws and regulations

Immigration laws, policies and regulations are changed frequently. As such, Universal Recruiting cannot be held liable for the effects of any such changes on the outcome of an application submitted around the time that any such change is implemented.

9. Governing law

9.1. All of the stipulations contained in this terms of service document/page including any and all disputes, will be governed by the laws of Canada. You agree to accept the personal jurisdiction and venue of Canada, and waive any future objection to said jurisdiction and venue.

9.2. Any claim against Universal Recruiting must be made within a period of six months after the event from which the claim stems, or else said claim (or course of action) will be deemed waived.

9.3. Should any dispute arise between the user/applicant/candidate and Universal Recruiting, all parties involved shall attempt to resolve said dispute promptly and in good faith.

9.4. In the event of the parties involved being unable to resolve a dispute within a a time frame that is reasonable, and within a period not exceeding 30 calendar days, either party reserves the right to move to mediation to resolve the dispute.

9.5. Should mediation fail to resolve said dispute, the parties reserve the right to recourse available to them under Canadian Law.
